Adjudication
John Hunter is a leading authority on Adjudication in the Scottish Construction market and has issued decisions on over 200 occasions. Appointments comprise nominations from the RICS, Scottish Building, the CIArb, the AICA, the PPA and other bodies.
A substantial number of nominations have been by agreement between the parties and coincidentally the agreed referrals have constituted the most substantial disputes upon which he has adjudicated.
John is regularly named as an adjudicator in construction contracts and was a named adjudicator on the Edinburgh Trams Project issuing three critical decisions.
His decisions have contributed to the jurisprudence of adjudication law in Scotland namely in the case of Skanska Construction v ERDC Group [2002] Ct of Session P1193/02 which supported John’s position and clarified the Scots law position on whether one can run a second adjudication based upon what constitutes information that is substantially the same as that considered in a previous adjudication.
